This Release & Waiver applies to, and is for the benefit of the Pine Tree Apple Classic Fund (PTACF), a Minnesota non-profit organization, including its Board of Directors, officers, employees and agents, volunteers, successors, as well the aforementioned organization and individuals who participate in any manner in the Pine Tree Apple Tennis Classic (PTATC).
LIKENESS RELEASE & WAIVER
I hereby grant the PTACF (d/b/a the PTATC) permission to use my likeness in a photograph, video, or other digital media (“image”), as well as biographical information, in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all images will become the property of the PTACF and will not be returned. I hereby irrevocably authorize the PTACF to edit, alter, copy, exhibit, publish, or distribute these images for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my image appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the image. I hereby hold harmless, release, and forever discharge the PTACF from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization or arising from the publication of the images.
LIABILITY RELEASE & WAIVER
Acceptance of my entry in this event is without assumption or responsibility of any kind by the PTACF. In consideration of the acceptance of my entry, I do hereby for and on behalf of myself, and my heirs and my legal representatives release and forever discharge the PTACF, its officers and directors, committees, and representatives and their successors and assigns, of and from any and all claims and damages, losses or injuries which may be suffered or sustained by me in connection with my activities during the period for which such permission is granted, which shall include all times in which I participate in the PTATC, including but not limited to warm-up and competition activities, attendance at any related activities and any period traveling to and from the PTATC, and all claims are hereby waived and released, and I covenant not to sue therefore.
MEDICAL RELEASE
I hereby consent to the rendering of emergency first aid and other medical procedures which at the time of injury or illness as seems reasonably advisable. I further understand that I will be responsible for payment of any such medical procedures. In consideration of the acceptance of my entry, I hereby agree to abide by all applicable rules and policies of the PTATC. I have read and have understood this Release & Waiver. I understand by signing this Release, I have given up substantial rights. I hereby hold harmless, release, and forever discharge the PTACF from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization or arising from my participation in the PTATC.
I have voluntarily signed this Release & Waiver. I am at least 18 years of age and I am competent to contract in my own name, or, in the alternative, if I am under eighteen (18) years of age, my parent or guardian represents that he/she is authorized to sign on my behalf. I have read this Release & Waiver and I fully understand the contents, meanings and impact of this Release and Waiver.
